If you are arrested for DUI, do not wait to talk to an attorney. The Department of Motor Vehicles will suspend or revoke your license prior to your Court date for up to three years or more without a hearing. You have no right to a public defender at DMV. DMV and Court actions remain on your driving record for life and can have consequences including: thousands of dollars in increases in insurance costs, exclusion from current or future employment, license revocation, suspension, or restriction, insurance costs and fines in the thousands of dollars, mandatory jail, drunk driving schools up to 30 months, and probation for up to five years. Your records can never be cleared or expunged of DMV suspensions.

Consequences for multiple offenders, refusals to take chemical tests, or alcohol involving minors, or drugs, are even more severe. Don’t let DMV or others confuse or stall you. You have many rights and defenses. Convictions, jail sentences, vehicle losses or impoundment, license revocations, suspensions or restrictions, interlock devices, fines and even probation, can be avoided. Many cases result in acquittals or reduction. It is critical that you speak to an attorney immediately.
1. Don’t represent yourself. Don’t discuss your case with anyone. Don’t sign anything. Don’t waive your rights. Law enforcement and the District Attorney are hired to convict you. Public defenders and court-appointed lawyers are hired by and paid by the government. When you’re arrested, immediately call an experienced, local, private attorney who specializes in criminal defense and DMV law. Demand a lawyer who will give you immediate personal attention.
2. An attorney who lives and practices where you are arrested has a great advantage. An experienced local attorney knows the people in the justice system you’ll be dealing with throughout your case. Demand his personal attention. Demand personal attention by a local experienced lawyer that you can not get out of town, telephonically, or by referral systems or from paralegals.
3. Use an experienced local attorney who specializes. Again, hold out for a lawyer who has been around. When you need an attorney for criminal defense or DMV, use an attorney who knows the local ins and outs. There is a lot to think about; get a good, specialized attorney who knows local rules, procedures, judges, district attorneys, probation officers, law enforcement, bail bonds, court, jail programs, and DMV.

DUI law is different than other types of criminal law. DMV hearings involve administrative law, Constitutional law, and criminal defense law. Few lawyers are versed in these fields. Beware of advertisements in yellow pages under "A", or attorney or law firm ads that indicate expertise in numerous fields. Most large yellow page ads and other ‘mailers’ distributed by many "legal firms" are merely referral systems that do not actually practice law in the County where you were arrested, or at all; but rather they make a living referring cases to other lawyers on a percentage or flat fee basis. Do not take advice from such referral systems, and do not take advice from secretaries, paralegals, or any other attorney that does not specialize in DUI and DMV law. If an attorney doest not tell you that you must contact DMV in Sacramento within 10 calendar days of your arrest, they are in malpractice, and probably know little else that will help you.
Lawyers have two commodities to offer: expertise and knowledge. Both are derived from years of experience. If you find a lawyer who is a DUI and DMV specialist with more than 35 years experience, who devotes his or her practice exclusively to DUI and DMV, hire that lawyer! Never settle for second-best.
